Terms of Service

1. Agreement to Terms

By accessing or using SiteSideKick ("Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). The Service includes our AI-powered chatbot platform, analytics dashboard, web scraping tools, and related features provided by SiteSideKick. If you do not agree with these Terms, you must not use the Service.

2. Use of the Service

SiteSideKick allows you to create and embed customized chatbots on your website by adding a provided script tag to your site’s head tag. Each chatbot is linked to a specific domain and uses only the context, documents, and settings you provide. You may also use certain automated tools, such as our web scraping functionality, as described in these Terms.

You agree to use the Service in compliance with all applicable laws and not for any unlawful or prohibited purpose. You are responsible for ensuring that your use of the Service, including any web scraping, data collection, or content processing, does not infringe on third-party rights or violate any laws, regulations, or terms of service of third-party websites.

3. User Content

You are solely responsible for all content you provide to the Service ("User Content"), including but not limited to company details, custom instructions, uploaded documents, scraped data, and chatbot configurations. You retain ownership of your User Content, but you grant SiteSideKick a worldwide, non-exclusive, royalty-free, transferable license to host, store, process, and display your User Content as necessary to provide the Service.

You represent and warrant that your User Content does not violate any laws, regulations, or third-party rights, including intellectual property, privacy, or publicity rights. SiteSideKick reserves the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

4. Subscription and Billing

SiteSideKick operates on a subscription model managed by Lemon Squeezy. Users are limited to one active subscription at a time, which auto-renews unless canceled. If you upgrade to a more expensive plan, you will be charged a pro-rata amount immediately. Subscription plans and features are subject to change with prior notice. You may cancel your subscription at any time through your account settings or by contacting dean@sitesidekick.io. Upon cancellation, you will retain access to the Service until the end of your current billing cycle.

Changes to Plans, Pricing, and Features. SiteSideKick reserves the right to modify plan offerings, pricing, limits, quotas, and the features included with any plan at any time, for any reason, and without prior approval from users. When we change pricing or plan features, we will use commercially reasonable efforts to provide notice (for example, via email or an in-app notification). Unless otherwise stated in the notice, changes to prices or features will take effect for new subscribers immediately and will apply to existing subscribers on their next renewal date. We may also:

  • Introduce new plans, promotional pricing, or retire existing plans.
  • Adjust usage limits, feature access, or API quotas for any plan.
  • Offer to "grandfather" existing subscribers under their current plan or migrate them to a new plan at our discretion.
  • Charge prorated or one-time fees related to plan changes or upgrades as described in our billing flow.

If you do not agree to a material change we make to pricing or plan features, your sole remedy is to cancel your subscription before the effective date of the change. Except as expressly provided in a separate agreement, SiteSideKick is not required to provide refunds for changes to pricing or features; any refunds are at our sole discretion and may be subject to the billing provider's policies.

SiteSideKick reserves the right to suspend or terminate your access to the Service for non-payment or violation of these Terms, with or without notice.

5. Analytics Dashboard

The Service includes an analytics dashboard that provides metrics and conversation logs for your chatbots. This data is derived from user interactions and is intended to help you monitor and improve chatbot performance. You acknowledge that analytics data is provided "as is" and may not be error-free.

6. Service Limitations

While we strive to provide a reliable and high-quality chatbot experience, the Service is provided "as is" and "as available." Chatbots and scraping tools may produce errors, incomplete responses, or unexpected behavior. You acknowledge that reliance on the Service, including chatbot interactions and web scraping results, is at your own risk. SiteSideKick is not responsible for any decisions or actions taken based on data obtained through the Service.

7. Limitation of Liability

To the fullest extent permitted by law, SiteSideKick, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, revenue, or business opportunities, arising from or related to your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless SiteSideKick, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service (including scraping features); (b) your User Content; (c) your violation of these Terms; or (d) your violation of any laws or third-party rights. SiteSideKick reserves the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense.

15. Web Scraping and Data Collection

The Service may include features that enable users to automatically collect or extract data from external websites or online sources ("Web Scraping"). You acknowledge and agree that:

  • You are solely responsible for ensuring that any web scraping or automated data collection you perform using SiteSideKick complies with all applicable laws, regulations, and the terms of service or robots.txt policies of the target websites.
  • You must not use SiteSideKick to scrape or collect data from websites where such activity is prohibited, restricted, or would infringe upon copyright, database rights, or other intellectual property or privacy rights.
  • SiteSideKick acts solely as a tool provider and does not control or monitor the targets, frequency, or data collected by users. We do not assume responsibility for how scraping tools are used or the data obtained.
  • You agree to indemnify and hold SiteSideKick harmless from any claims, damages, or liabilities arising from your use of web scraping or automated data collection features.
  • SiteSideKick reserves the right to limit, suspend, or terminate access to web scraping or data collection features at any time, with or without notice, including where we believe such use may breach third-party rights or applicable law.

SiteSideKick makes no guarantees about the accuracy, completeness, or legality of any scraped or collected data and provides all scraping-related features on an "as is" basis without warranty of any kind.

16. Bugs, Errors, and Service Reliability

While SiteSideKick strives to provide a stable, secure, and reliable experience, you acknowledge that software bugs, service interruptions, and other technical issues may occur from time to time. SiteSideKick will make reasonable efforts to identify and fix reported bugs or disruptions promptly, but we do not guarantee that the Service will be free from errors, defects, downtime, or data loss.

The Service, including all features such as AI chatbots, analytics, and web scraping, is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. SiteSideKick disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

SiteSideKick shall not be liable for any loss, damage, or inconvenience caused by software errors, temporary unavailability, data corruption, or unexpected behavior of the Service. You understand that using online software inherently involves certain risks, and you agree to use the Service at your own discretion and risk.

You agree to indemnify and hold harmless SiteSideKick, its officers, affiliates, and employees from any claims, damages, or losses resulting from reliance on, or issues caused by, any bugs, downtime, or malfunction in the Service.
